These Terms and Conditions apply to the use of this website and to any order placed with us through this website, by telephone, by email, or by any other method we accept.

Please read these Terms carefully before placing an order. By using our website or placing an order with us, you agree to be bound by these Terms.

1. About us

2. Definitions

In these Terms:

“Business Customer” means a customer purchasing goods wholly or mainly for business, trade, profession, resale, installation, contracting or commercial purposes.

“Consumer” means an individual purchasing goods wholly or mainly for personal use and not for business, trade, craft or professional purposes.

“Goods” means the products, items, materials, components, accessories, equipment or other goods supplied by us.

“Order” means an order placed with us for Goods.

“Returns Policy” means our returns policy available on our website.

“Website” means www.rselectricalsupplies.co.uk and any related page operated by us.

“Working Day” means Monday to Friday, excluding bank holidays in England and Wales.

3. Who these Terms apply to

These Terms apply to Consumers and Business Customers.

Some provisions apply differently to Consumers and Business Customers. Where a clause applies only to Consumers or only to Business Customers, this will be made clear.

Nothing in these Terms affects any legal rights that a Consumer cannot lawfully be required to give up.

4. Our website

We try to keep the Website accurate, available and up to date. However, we do not guarantee that the Website will always be available, uninterrupted, secure or free from errors.

We may update, suspend, withdraw or change any part of the Website at any time.

You must not misuse the Website, attempt to interfere with its operation, introduce malicious code, scrape it unlawfully, or use it for any fraudulent, illegal or unauthorised purpose.

5. Product information and suitability

We take reasonable care to ensure that product descriptions, specifications, images, prices, stock and delivery information are accurate. Images are for illustration only, and packaging, colours, branding, dimensions and appearance may vary.

Any product guidance or recommendations we provide are based on the information supplied by you and are intended to assist with product selection only. They do not replace advice or confirmation from a suitably qualified electrician, contractor or other competent professional.

You and your installer are responsible for checking that the Goods are suitable and compatible with the intended installation, system, environment and applicable regulations before ordering, installing or using them.

We are not responsible for incorrect product selection resulting from incomplete or inaccurate information, failure to carry out appropriate checks, or use contrary to the manufacturer’s instructions.

Nothing in these Terms affects your statutory rights or excludes liability that cannot legally be excluded.

6. Electrical installation and safety

Many Goods sold by us are intended for installation, inspection or use by competent persons.

You are responsible for ensuring that Goods are installed, maintained and used safely, correctly and in accordance with all applicable laws, regulations, manufacturer instructions, wiring regulations, safety standards and good industry practice.

Where required, Goods should be installed or inspected by a qualified electrician or suitably competent person.

We are not responsible for loss, damage, injury, failure or non-compliance caused by incorrect installation, misuse, unsuitable application, poor maintenance, alteration, neglect or use contrary to manufacturer instructions.

This clause does not limit any liability that cannot legally be limited or excluded.

7. Prices, VAT and ex-VAT information

Prices shown on the Website are shown in pounds sterling.

Unless clearly stated otherwise, the main price displayed for Goods on the Website is inclusive of VAT at the applicable UK rate.

Where we display an ex-VAT price, this is provided for information only, usually to assist trade and business customers. The ex-VAT price is not the checkout price and is not used as the final amount payable at checkout.

The price payable by you is the VAT-inclusive price shown at checkout, together with any applicable delivery charges or other charges clearly shown before you complete your Order.

Delivery charges will be shown before you place your Order where applicable.

We may change prices at any time. Price changes will not affect Orders we have already accepted, except where there has been an obvious pricing error.

8. Pricing errors

Although we try to ensure all prices are accurate, errors may occur.

If we discover an obvious pricing error after you place an Order, we may contact you to give you the option to continue at the correct price or cancel the Order.

If we cannot contact you using the details provided, we may cancel the Order and refund any payment already made.

We are not required to supply Goods at an incorrect price where the pricing error is obvious and could reasonably have been recognised as a mistake.

9. Placing an Order

When you place an Order, you are making an offer to purchase the Goods.

Your Order is not accepted until we confirm acceptance, dispatch the Goods, or otherwise confirm that the Order is being processed.

We may refuse or cancel an Order where:

a. the Goods are unavailable;
b. payment has not been authorised;
c. there is an error in the price or description;
d. we suspect fraud, misuse or unauthorised activity;
e. delivery is not available to your location;
f. the Order appears to be placed by a reseller, distributor or third party in breach of these Terms;
g. we are unable to fulfil the Order for any other reasonable reason.

If we cancel an Order after payment has been taken, we will refund the amount paid for any Goods not supplied.

10. Product availability, pre-orders and back orders

Stock availability shown on the Website is provided as a guide only and may change.

Some Goods may be available for pre-order, back order, special order or supplier-direct dispatch. Estimated dates are not guaranteed unless we expressly state otherwise.

If Goods are delayed, unavailable or discontinued, we may contact you to offer an alternative, a revised delivery date, a partial dispatch or a refund.

For Business Customers, special order, non-stock, supplier-ordered, bespoke, cut-to-length, configured or assembled Goods may not be cancellable or returnable unless faulty or incorrectly supplied.

For Consumers, cancellation and return rights for special order or customised Goods will apply only to the extent required by law.

11. Kits, bundles and assembled products

Some Goods may be sold as kits, bundles, packs or assembled product sets made up of more than one component.

The components included in a kit or bundle may be listed on the product page, in the order confirmation, or in other information provided by us.

Where a kit or bundle is returned, all components, packaging, accessories and included items must be returned together unless we agree otherwise.

If only part of a kit or bundle is returned, we may refuse the return or make a reasonable deduction from any refund where permitted by law.

For Business Customers, kits, bundles or assembled products made to a specific requirement may be treated as special order or configured Goods.

This clause does not affect Consumer statutory rights where Goods are faulty, incorrect or not as described.

12. Payment

You must pay for Goods, delivery and any applicable charges at the time of ordering, unless we have agreed credit terms with you in writing.

We may use third-party payment providers to process payments. We do not store your full card details.

Where a payment is reversed, declined, charged back or not received, we may suspend or cancel the Order.

For approved credit accounts, payment must be made in accordance with the agreed credit terms. We may suspend further supply if invoices are overdue.

13. Delivery

We will deliver to the delivery address you provide when placing the Order.

You are responsible for ensuring the delivery address, contact details and delivery instructions are accurate and complete.

Delivery times are estimates only unless we expressly agree a guaranteed delivery service in writing.

We are not responsible for delay caused by courier issues, incorrect address details, failed delivery attempts, customs or border delays, weather, events outside our control, or any other matter beyond our reasonable control.

If delivery is delayed, we will try to keep you informed where reasonably possible.

Supplier-direct deliveries

To help deliver Goods more quickly, we may arrange for all or part of an Order to be dispatched directly by a manufacturer, supplier or fulfilment partner.

Supplier-direct Goods may arrive separately from other items in your Order, on a different date, through a different courier or with separate tracking information.

RS Electrical Supplies remains the seller and your point of contact for the Order. Supplier-direct dispatch does not reduce or affect a Consumer’s statutory rights.

To arrange fulfilment and delivery, we may provide the relevant supplier and courier with the limited customer and Order information reasonably required to complete the delivery. Further information is provided in our Privacy & Cookies Policy.

14. Delivery instructions, safe places and nominated recipients

If you provide delivery instructions to us or to the courier, including a request to leave Goods in a safe place, with a neighbour, at a revised address, on a specific date, or with a nominated recipient, you are responsible for ensuring those instructions are suitable and secure.

Where the courier confirms delivery in accordance with your instructions, delivery will normally be treated as complete.

For Consumers, risk in the Goods passes to you when the Goods come into your physical possession or into the physical possession of a person you have identified to receive them.

If you instruct the courier to leave Goods in a safe place, with a neighbour, at a revised address or with another nominated person, that location or person may be treated as having been identified by you to receive the Goods.

We are not responsible for loss, theft or damage after delivery has been completed in accordance with your authorised delivery instructions, unless the loss, theft or damage was caused by our breach of contract, negligence or another matter for which we are legally responsible.

If you believe Goods have not been delivered as instructed, you must tell us as soon as possible so that we can investigate with the courier.

15. Failed delivery and incorrect address details

If Goods cannot be delivered because the address or contact details supplied by you are incorrect or incomplete, or because you fail to accept delivery, we may charge you for reasonable redelivery, storage, return or courier charges.

If Goods are returned to us following failed delivery, we may cancel the Order and refund you the price of the Goods, less any delivery, return, storage or reasonable handling costs we are entitled to deduct by law.

This does not affect Consumer statutory rights.

16. Inspection on delivery

You should inspect Goods as soon as reasonably possible after delivery.

If Goods appear damaged, missing, incorrect or incomplete, you should contact us promptly with your order number, photographs where relevant, and details of the issue.

For Business Customers, damage, shortages, incorrect Goods or delivery discrepancies must be reported in writing within 3 Working Days of delivery.

If a Business Customer does not notify us within that period, the Goods will be treated as delivered complete and in good condition, except for faults that could not reasonably have been discovered on inspection.

For Consumers, this clause does not remove or reduce your statutory rights.

17. Consumer cancellation rights

If you are a Consumer and you buy Goods online, by telephone or by email, you may have the legal right to cancel your Order without giving a reason.

Unless an exception applies, you usually have 14 days from the day after you, or someone nominated by you, receives the Goods to tell us that you wish to cancel.

If your Order is delivered in more than one delivery, the cancellation period usually runs from the day after you receive the final delivery.

To cancel, you must clearly tell us that you wish to cancel. You can do this by emailing hello@rselectricalsupplies.co.ukor by using the cancellation form at the end of these Terms.

You must return the Goods to us within 14 days of telling us that you wish to cancel.

For unwanted Goods or change-of-mind returns, you are responsible for the cost of returning the Goods to us unless we have agreed otherwise.

We do not currently provide free return labels for unwanted Goods or change-of-mind returns.

18. Exceptions to Consumer cancellation rights

Consumer cancellation rights may not apply to certain Goods, including:

a. Goods made to your specification or clearly personalised;
b. Goods cut to length, modified, configured, assembled or ordered to your specific requirements;
c. sealed Goods that are not suitable for return for health protection or hygiene reasons once unsealed;
d. Goods that have been inseparably mixed with other items after delivery;
e. Goods that have been installed, used, damaged, altered or handled beyond what is necessary to inspect them, where a deduction is permitted by law.

This clause applies only where the law allows.

Nothing in this clause affects your rights if Goods are faulty, incorrect, damaged before delivery, not as described, or otherwise fail to meet your legal rights.

19. Consumer refunds after cancellation

If you cancel an Order under your Consumer cancellation rights, we will refund the price paid for the Goods and the standard delivery charge, where applicable.

If you selected a premium, express or enhanced delivery option, we are only required to refund the cost of the least expensive standard delivery option available for your Order.

You are responsible for returning the Goods to us at your own cost unless the Goods are faulty, incorrect, not as described, or we have agreed to pay the return cost.

We may make a reasonable deduction from the refund if the Goods have lost value because you handled them more than was necessary to establish their nature, characteristics and functioning.

We may withhold the refund until we have received the Goods back or until you provide evidence that you have sent them back, whichever happens first.

Refunds will be made using the original payment method unless we agree otherwise.

20. Returns outside Consumer cancellation rights

Returns outside legal cancellation rights are handled in accordance with our Returns Policy.

We may, at our discretion, accept returns of unwanted Goods where:

a. you have contacted us within the return period stated in our Returns Policy;
b. the Goods are unused, undamaged, complete and in resaleable condition;
c. the Goods are returned with all packaging, instructions, accessories and components;
d. the Goods are not special order, bespoke, cut-to-length, configured, obsolete, clearance or non-returnable items;
e. you follow our returns process.

For unwanted Goods or change-of-mind returns, the customer is responsible for arranging and paying for return postage unless we agree otherwise.

We may refuse a return or make a deduction where Goods are used, damaged, incomplete, installed, marked, missing packaging, or not in resaleable condition.

We do not currently charge a separate return label fee or return processing fee for standard customer-arranged returns.

This clause does not affect Consumer statutory rights for faulty, incorrect or misdescribed Goods.

21. Faulty, incorrect or misdescribed Goods

If Goods are faulty, incorrect, damaged before delivery, not as described, or otherwise do not meet your legal rights, please contact us as soon as possible.

Consumers have legal rights in relation to Goods that are faulty, not as described, not of satisfactory quality or not fit for purpose. Nothing in these Terms affects those rights.

Depending on the circumstances, Consumers may be entitled to a repair, replacement, refund, price reduction or other remedy required by law.

Where Goods are faulty, incorrect or not as described, we will not require you to pay the reasonable cost of returning those Goods to us.

Business Customers must notify us of faults or defects within a reasonable time and comply with any inspection, testing or returns process we reasonably require.

We may ask you to provide photographs, installation details, batch numbers, manufacturer information, proof of purchase, or other information reasonably required to assess the issue.

Where Goods are returned as faulty but no fault is found, or the fault was caused by misuse, incorrect installation, accidental damage, alteration, neglect or normal wear and tear, we may reject the claim and may charge reasonable return, testing or inspection costs where permitted by law.

22. Manufacturer warranties

Some Goods may include a manufacturer or supplier warranty, subject to their own terms, exclusions and claims process.

Unless stated otherwise, we will administer warranty claims during the first 12 months from the date of purchase. Where a longer manufacturer or supplier warranty applies, claims after the first 12 months will normally need to be made directly with the manufacturer or supplier.

We may assist with these claims where reasonably possible, but we are not responsible for decisions made by the manufacturer or supplier under their warranty.

Manufacturer and supplier warranties are additional to, and do not affect, your statutory rights against us.

23. Obsolete, discontinued and replacement products

Some Goods may be marked as obsolete, discontinued, replaced, superseded or no longer available for purchase.

Where we provide a suggested replacement or alternative product, this is provided as guidance only.

You are responsible for checking that any replacement or alternative product is suitable for your intended purpose, installation, specification, system and regulatory requirements.

We are not responsible for loss, damage, incompatibility or additional costs arising from your selection or use of a replacement or alternative product unless caused by our breach of contract, negligence or another matter for which we are legally responsible.

This clause does not affect Consumer statutory rights.

24. Business Customer terms

This section applies to Business Customers only.

Business Customers are responsible for ensuring that Goods are suitable for their intended use, installation, project, specification, system, customer requirements and regulatory obligations.

Business Customers must inspect Goods immediately on delivery and notify us in writing of any damage, shortage, incorrect Goods or delivery discrepancy within 3 Working Days.

Business Customers must notify us of any defect that could not reasonably have been discovered on inspection within a reasonable period after discovery.

Business Customers may not return Goods unless:

a. the Goods are faulty;
b. the Goods were incorrectly supplied by us;
c. we have agreed the return in writing; or
d. our Returns Policy expressly allows the return.

Business Customer returns may be subject to restocking charges, supplier charges, carriage charges, testing charges or handling charges.

Special order, non-stock, bespoke, cut-to-length, configured, assembled, clearance, discontinued or obsolete Goods are not returnable by Business Customers unless faulty or incorrectly supplied.

To the fullest extent permitted by law, we are not liable to Business Customers for loss of profit, loss of business, loss of contract, loss of revenue, loss of opportunity, loss of goodwill, loss of anticipated savings, labour costs, contractor costs, delay costs, call-out charges, installation costs, removal costs, refitting costs, consequential loss or indirect loss.

Subject to the clauses that cannot legally be excluded, our total liability to a Business Customer for any Order is limited to the price paid for the Goods giving rise to the claim.

25. Product recalls and safety notices

If a product recall or safety notice applies to Goods you have purchased from us, we may contact you using the details provided at the time of purchase.

You must follow all recall instructions, safety notices and manufacturer guidance.

You should ensure your account and contact details remain accurate so that we can contact you where necessary.

26. Accounts and customer information

You must provide accurate, current and complete information when placing an Order or creating an account.

You are responsible for maintaining the confidentiality of your account login details and for all activity under your account.

You must tell us promptly if you believe your account has been accessed without permission.

We may suspend or close accounts where we reasonably suspect fraud, misuse, abuse, security risks or breach of these Terms.

27. Promotions, discounts and voucher codes

Promotions, discounts and voucher codes are subject to availability and any specific terms stated with the promotion.

We may withdraw, amend or refuse a promotion, discount or voucher code where it has expired, is being misused, has been issued in error, or does not apply to the Goods or Order.

Discounts cannot usually be applied retrospectively unless we agree otherwise.

28. Third-party services and links

Our Website may include links to third-party websites, services, payment providers, finance providers, couriers, review platforms or other external tools.

We are not responsible for the content, accuracy, availability, policies, actions or services of third-party websites or providers.

Your use of third-party services may be subject to separate terms and privacy policies.

Our store is hosted on Shopify Inc., which provides the ecommerce platform used to sell our Goods online.

29. Reviews, comments and user content

If you submit reviews, comments, feedback, images or other content to us or through the Website, you must ensure that the content is accurate, lawful and does not infringe the rights of any third party.

We may use, display, edit, remove or refuse user content where reasonably necessary, including where content is unlawful, offensive, misleading, abusive, defamatory, infringing, fraudulent, spam, or otherwise unsuitable.

You must not submit false reviews or impersonate another person.

30. Intellectual property

All content on the Website, including text, images, logos, graphics, icons, layout, design, product content and code, belongs to us or our licensors unless stated otherwise.

You may use the Website for personal or internal business purchasing purposes only.

You must not copy, reproduce, distribute, modify, scrape, commercially exploit or use Website content without our prior written permission, except where allowed by law.

31. Privacy and personal data

We process personal data in accordance with our Privacy Policy.

Our Privacy Policy explains what personal data we collect, how we use it, who we share it with, how long we keep it, and your rights.

By using the Website or placing an Order, you acknowledge that your personal data will be processed in accordance with our Privacy Policy.

32. Limitation of liability

Nothing in these Terms excludes or limits our liability for:

a. death or personal injury caused by our negligence;
b. fraud or fraudulent misrepresentation;
c. breach of your statutory rights as a Consumer;
d. liability under product safety laws;
e. any other liability that cannot legally be excluded or limited.

For Consumers, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, but we are not responsible for losses that are not foreseeable.

For Consumers, we only supply Goods for domestic and private use unless we agree otherwise. If you use Goods for commercial, business or resale purposes, the Business Customer provisions may apply.

For Business Customers, our liability is limited as set out in the Business Customer section of these Terms.

We are not responsible for loss or damage caused by misuse, incorrect installation, unsuitable product selection, failure to follow instructions, unauthorised alteration, neglect, normal wear and tear, or use of Goods outside their intended purpose.

33. Events outside our control

We are not responsible for delay or failure to perform our obligations where caused by events outside our reasonable control.

This may include courier delays, supplier delays, shortages, strikes, transport disruption, extreme weather, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, regulatory changes, utility failure, cyber incidents or other events beyond our reasonable control.

If an event outside our control affects your Order, we will contact you where reasonably possible and take reasonable steps to reduce the impact.

34. Changes to these Terms

We may update these Terms from time to time.

The Terms that apply to your Order will usually be the Terms in force when your Order is placed.

The latest version of these Terms will be available on the Website.

Your continued use of the Website after changes are posted means you accept the updated Terms for future use and future Orders.

35. Severance

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be treated as removed to the minimum extent necessary.

The remaining parts of these Terms will continue to apply.

36. No waiver

If we do not enforce a right under these Terms, this does not mean we have waived that right.

We may still enforce that right later.

37. Transfer of rights

We may transfer our rights and obligations under these Terms to another organisation, provided this does not reduce your rights.

You may not transfer your rights or obligations under these Terms without our written consent, unless the law allows otherwise.

38. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a Consumer, you may bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in Scotland or Northern Ireland.

If you are a Business Customer, the courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, the Website or any Order.

39. Complaints and contact

If you have a question, complaint or issue with an Order, please contact us as soon as possible.

These Terms should be read together with our:

a. Returns Policy;
b. Privacy Policy;
c. Cookie Policy;
d. Delivery or Shipping Policy;
e. any product-specific terms shown on the relevant product page.

If there is a conflict between these Terms and a product-specific term, the product-specific term will apply to that product, provided it is lawful.

Nothing in any policy limits Consumer statutory rights.
